Organiser Terms and Conditions

Please read this agreement before creating your organiser account. It explains what Tickety provides, your event responsibilities and how proceeds are settled.

1. Agreement and authority

This agreement is between Webfit Solutions Limited, trading as Tickety (Tickety, we, us), and the person or organisation registering as an event organiser (you). Tickety operates in New Zealand. Contact: info@tickety.co.nz.

By actively selecting the agreement checkbox and submitting organiser signup, you agree to this version of the Organiser Terms and Conditions. You must be at least 18 and authorised to represent the organiser. If acting for an organisation, you identify and bind that organisation; you do not personally guarantee its debts merely by registering as its authorised representative.

These terms cover organiser services. Our Terms of Service, Privacy Policy and Refund Policy also apply. These organiser terms take priority for organiser services if there is a conflict; mandatory legal rights always take priority. A separately agreed written service arrangement takes priority only for the matters it expressly varies.

2. What Tickety provides

Tickety provides a web platform for event listings, ticket sales and registration, digital ticket issuance, order records, organiser tools and ticket validation. We use reasonable care and skill to issue valid tickets for successfully completed, authorised orders and provide customer support for technical issues within our service.

A valid ticket records the entitlement configured by the organiser. Tickets can later become invalid through refund, cancellation, prior use, fraud or an authorised correction. A ticket is not a guarantee that a person will attend or that the organiser will deliver the event.

Unless agreed separately in writing, Tickety is not the event organiser, promoter, venue, security provider or performer. You remain responsible for delivering the event, managing entry and making lawful admission decisions. Nothing here excludes responsibility for Tickety’s own acts or omissions where applicable law requires it.

3. Account details and security

Provide accurate name, email, mobile number and organisation details, keep them current, and monitor your contact email. Keep credentials and staff access links secure. Give access only to authorised people and remove it promptly when no longer required.

Notify Tickety promptly about suspicious activity, unauthorised access or incorrect orders. You are responsible for actions you authorise and for reasonable security precautions; you are not automatically responsible for a security failure caused by Tickety.

We may request proportionate identity, event authority and bank-account verification before enabling sales or paying proceeds. We will explain what is needed and protect information under our Privacy Policy.

4. Your event responsibilities

You must have authority to offer the event and permission to use all submitted content. Check dates, venue, seating, capacity, ticket quantities, prices, age restrictions, accessibility information, performers, inclusions and refund conditions before publishing and throughout sales.

You are responsible for venue arrangements, permits, licences, insurance appropriate to your event, health and safety, accessibility, safeguarding, alcohol rules, security, staff and delivery of advertised services. You must comply with applicable New Zealand law and clearly disclose material restrictions before booking.

Do not oversell capacity across Tickety and other channels. Promptly tell affected customers and Tickety of cancellation, postponement, venue changes, materially changed inclusions or safety concerns. Obtain approval before using Tickety’s name or logo in a way suggesting endorsement or partnership.

5. Promotion, sales and attendance

Marketing, promotion, attendance and commercial success are your responsibility unless Tickety expressly agrees to specific promotional services in writing. Listing an event does not guarantee advertising, reach, ticket sales, revenue or attendance.

Tickety does not compensate you merely because a ticket buyer does not attend, attends late, leaves early, or because registrations exceed actual attendance. For free events, registrations are expressions of intention, not guaranteed attendance. These provisions do not remove remedies for loss caused by a proven breach by Tickety.

You should plan event capacity, reminders, catering and staffing using your own assessment. Do not treat free registrations or complimentary tickets as paid revenue or a guaranteed headcount.

6. Prices, fees and taxes

Applicable ticketing and payment-processing fees must be disclosed through the pricing information or a written quote before you commit to them. Depending on the selected configuration, fees are passed to the buyer or absorbed by you. Buyer totals must be clear before payment. The agreed fee configuration and pricing in effect for each transaction apply to that transaction.

Free, complimentary and offline tickets do not create online proceeds payable by Tickety. Any charges for these services or additional work must be disclosed and agreed in advance. You are responsible for your own GST, income tax and event invoicing obligations; Tickety is responsible for its own taxes.

Future fee changes require reasonable advance notice and apply prospectively. They do not retrospectively change completed transactions. If you do not agree, you may stop future sales and close the account after existing obligations are resolved.

7. Payments

Online payments are collected through Tickety. Payout follows the final event day and reconciliation, with agreed fees, refunds and other documented adjustments deducted. Promotion and attendance are the organiser’s responsibility.

You authorise Tickety to collect online ticket payments for your event through its payment providers, including Stripe. During sales, online payments are collected through Tickety’s payment arrangements and, once the processor settles them, are paid into Tickety’s nominated bank account. They are not paid directly into your bank account as each ticket is sold.

A successful order is different from cleared funds: processing, settlement, fraud review and reversals can affect availability. Tickety keeps records of the amount attributable to your event. This agreement does not represent that proceeds are held in a separate trust or escrow account.

Cash, bank transfers or other payments you collect directly remain your responsibility even when recorded as offline sales in Tickety. Record the actual payment status and method accurately. Tickety cannot pay out money it has not received.

8. Final settlement and organiser payout

Payout takes place after the final day of the event and completion of final reconciliation, to the bank account you have nominated and Tickety has verified. For a multi-day event, the final day means the last scheduled day of the event unless a different settlement arrangement is agreed in writing.

The payout is cleared online proceeds attributable to your event, less agreed fees, refunds, payment reversals, chargebacks and their applicable costs, previously paid amounts and separately agreed service charges. No item will be deducted twice. Tickety will provide a settlement breakdown and explain deductions.

We will normally initiate payout within 3 business days after the final event day, provided reconciliation is complete, funds have cleared and bank details are verified. If one of these requirements is outstanding, we will notify you of the reason and initiate payout within 3 business days after it is resolved, subject only to any justified hold described below. Business days exclude New Zealand public holidays and weekends. Bank and processor timing can affect when money arrives; same-day bank receipt is not promised.

You must provide the correct account holder name and bank account number and evidence of your authority where requested. Bank-detail changes may require independent verification to prevent fraud. If Tickety follows incorrect details you supplied, we will reasonably assist recovery, but recovery is not guaranteed. Tickety remains responsible for its own payment errors.

We may temporarily retain only amounts reasonably needed for identified refunds, disputes, chargebacks, suspected fraud, uncleared funds or legal requirements. We will explain the reason, amount and review conditions unless legally prohibited, review the hold reasonably and release unaffected or no-longer-required amounts promptly. We will not hold funds indefinitely without a justified basis.

A payout does not extinguish later valid refund or chargeback obligations. Tickety may seek documented amounts attributable to your event after payout and, after notice, offset legally recoverable amounts against future proceeds. You may dispute calculations and request evidence. No interest, debt collection fee or penalty is imposed merely by this clause.

9. Cancellations, refunds and disputes

Publish a clear and lawful refund policy before sales. A no-refunds statement does not override statutory rights. You are responsible for delivering the event and funding refunds or other remedies arising from your cancellation, non-performance, misleading information or material changes where required by law.

Where a cancellation requires a refund, refunds must include amounts and booking fees required by applicable law. Do not assume payment-processing fees are recoverable from the processor or can lawfully be withheld from customers. Any non-recoverable costs allocated to you must be explained and must reflect the applicable law and agreed pricing.

You authorise Tickety to process refunds you approve and refunds or reversals required by law or payment-provider rules. Tickety will notify you and provide relevant records. If funds are insufficient after payout, you must arrange funding for legally owed amounts within a reasonable timeframe agreed in the notice.

Provide truthful evidence for payment disputes, including event delivery and check-in records, within the relevant deadline. A ticket PDF alone does not establish that a cardholder authorised a payment. Disputes are decided by the relevant payment provider or bank, and Tickety does not guarantee success.

Responsibility for losses is allocated according to the cause and applicable law. You are not required to reimburse losses to the extent caused by Tickety’s breach, negligence or unauthorised actions. Customers retain their rights against any party responsible under law.

10. Offline, manual, complimentary and free tickets

Use the available organiser tools to record offline sales and issue complimentary or free tickets. You must accurately configure entitlements, recipient details and quantities, observe capacity limits and clearly distinguish paid, unpaid, free and complimentary orders.

You are responsible for payments collected outside Tickety, receipts, cash security, tax records and customer communications about those payments. Recording a manual sale does not mean Tickety received its payment or verified it.

Dedicated Tickety staff assistance for manual ticket issuance, data entry or event support may be arranged subject to availability and a separate written quote. Scope, staffing, timing, travel costs, fees and cancellation arrangements must be agreed before work starts. This service is not included automatically with platform access.

Staff assistance does not transfer your event safety, capacity, cash handling or customer refund obligations to Tickety unless expressly agreed and lawful. You must supply accurate instructions and check the completed records.

11. Ticket delivery and validation

The organiser can generate a restricted scanning URL from the event check-in dashboard and share it with authorised entry staff. Staff can open the URL on a supported phone or tablet browser and scan tickets without an organiser login. Successful scans update the dashboard, which shows tickets scanned and tickets still pending.

The organiser must arrange and provide entry staff, scanning devices, internet access and event admission. Tickety provides education and training on using its scanning tools and technical support; Tickety does not supply scanning or entry staff as part of the platform service.

Tickety supports digital tickets and validation of issued ticket records. You must ensure your entry team is trained, uses authorised scanner access, checks the correct event and understands duplicate, cancelled, refunded and previously used ticket responses.

Prevent unauthorised sharing of ticket QR codes and staff scanner links. Maintain reasonable contingency plans for connectivity, devices, queues and customer identity issues. Do not admit someone solely on an unchecked screenshot when a ticket’s validity is disputed.

Email can be delayed, filtered or rejected by a recipient’s provider. Tickety will reasonably assist with technical delivery issues and available ticket retrieval options. You must provide accurate attendee contact details and an accessible contact point for event-specific questions.

12. Web access, mobile use and support

At the date of this version, Tickety operates through its web interface; a publicly available Tickety mobile app is not provided. An app is work in progress, with no promised launch date or feature commitment under this agreement.

The web application is designed to work on mobile devices and, to the best of our knowledge, is mobile friendly on supported modern browsers. This is not a promise that every device, browser or network will support every function. Test your intended devices and entry setup before the event.

We welcome feedback at info@tickety.co.nz and will consider reasonable improvements. Technical support covers Tickety account, checkout, ticket issuance, delivery and validation issues. Event content, promotions, venue management and attendance remain your responsibility. No dedicated staff, 24-hour response or event-day service level is included unless agreed in writing.

We work to maintain reliable access but cannot promise uninterrupted service. Payment, email, hosting and network providers can affect availability. We will take reasonable steps to address incidents within our control and communicate material issues; third-party involvement does not remove our legal obligations.

13. Privacy and attendee information

We handle personal information under our Privacy Policy and applicable New Zealand privacy law. Your name, email, mobile number, accepted agreement version and acceptance time are recorded for contract administration. A copy of the agreement is emailed to your supplied email with info@tickety.co.nz copied for Tickety’s records. This does not constitute marketing consent.

Use attendee information only for lawful purposes with an appropriate legal basis. Protect exports and staff access, collect only information needed and comply with consent, sender identification and unsubscribe requirements for marketing. Ticket purchase or registration alone is not blanket permission for unrelated marketing.

Notify Tickety promptly of suspected privacy breaches involving platform data and cooperate with required assessment, notification and remediation. Each party remains responsible for its own privacy duties.

14. Content and acceptable use

You retain ownership of your content and grant Tickety a non-exclusive licence to host, reproduce, resize and display it as reasonably needed to provide the service and list your event. Optional promotional use outside ordinary event listing requires appropriate permission. You warrant that you have the necessary rights.

Do not publish illegal, fraudulent, discriminatory, unsafe or infringing events or content, misrepresent charitable status or sponsorship, use stolen payment information, scrape personal data, introduce malware or bypass security. Tickety owns or licenses its platform and brand; you may not copy or commercially exploit them without permission.

15. Suspension and ending the agreement

Tickety may proportionately restrict sales, content or access where reasonably necessary to address unlawful activity, material breach, credible fraud or safety risk, or legal or processor requirements. We will normally give reasons and an opportunity to resolve the issue; urgent protective action may be taken first.

You may stop using the service and request account closure. Suspension or closure does not remove existing tickets, customer remedies, settlement, refund, dispute or legally required recordkeeping obligations. Undisputed proceeds remain payable subject to the justified settlement provisions above.

16. Responsibility, loss and events outside control

Each party is responsible for its own breach, negligence and unlawful acts under applicable law. Tickety does not assume event delivery, promotion or attendance obligations merely by issuing tickets. Neither party is entitled to recover the same loss twice, and both must take reasonable steps to limit avoidable loss.

To the extent permitted by law, neither party is liable to the other for indirect or consequential business losses that were not reasonably foreseeable when this agreement was made. This does not exclude payment of collected proceeds, required refunds, liability for fraud or wilful misconduct, or rights and liabilities that cannot lawfully be excluded.

An event outside reasonable control may delay performance. The affected party must promptly explain the impact and take reasonable mitigation steps. This clause does not automatically permit retention of customer payments or remove refund rights or duties to account for proceeds.

Nothing in this agreement excludes, restricts or modifies non-excludable rights under the Consumer Guarantees Act 1993, Fair Trading Act 1986, Privacy Act 2020 or other applicable law. There is no blanket contracting out of consumer guarantees in this agreement.

17. Changes and acceptance records

Your accepted version and time are recorded, and the emailed PDF copy includes your name, email, mobile number, accepted agreement version, recorded date and time in New Zealand time, and checkbox acceptance, and preserves the terms accepted at signup. Keep that copy. Later website edits do not retrospectively replace this agreement for completed transactions.

Material changes require reasonable advance notice and fresh acceptance before applying to future organiser services. We will not use a general change clause to retrospectively alter settled fees or remove accrued rights. Contact Tickety if you wish to discuss a proposed change or end future use.

18. Questions, disputes and governing law

Contact info@tickety.co.nz with the event or order reference and a clear description of the concern. Both parties will first try in good faith to resolve it and provide relevant information within a reasonable time. This does not prevent urgent action or use of statutory complaint and dispute processes.

New Zealand law governs this agreement. New Zealand courts and the Disputes Tribunal, where it has jurisdiction, may determine disputes. Mandatory rights to use other lawful forums are preserved. If a provision is unenforceable, the remaining provisions continue to the extent they can operate fairly and lawfully.
